COMMERCIAL COURT REMANDS 24 YEAR OLD PHONE DEALER
The Kumasi commercial court today remanded a 24 year old hawker who deals in used cell phones Sarfo Manu aka Frank Owusu for two weeks in Prisons custody.
The court presided over by Her Lordship Mrs Lydia Osei Marfo after hearing both the prosecution and the accused, ordered the prosecution to take the accused to the prisons custody and adjourned the case to 28th of December 2016.
However presenting the facts police prosecutor DSP Doris Amewu told the court that the accused has committed two criminal offences and they are robbery contrary to section 149 of the criminal offences Act, 1960 (Act 29).

STATEMENT OF OFFENCE
ROBBERY: CONTRARY TO SECTION 149 THE CRIMINAL OFFENCES ACT, 1960 (ACT 29)
PARTICULARS OF OFFENCE
1, Sarfo Manu aka Frank Owusu 24 Hawker. For that the accused on 9th day of July, 2016 at Nyankyerenease New site near Asuyeboah in the Ashanti region within the jurisdiction of the court did rob Ellen Animah Agyei of her Itel cell phone valued GHc 195.00 HP Pavilion laptop computer valued GHc 1,200.00 and cash the sum of GHc 1,100.00
FACTS:
DSP Amewu further stated the complainants Samuel Kwaku Agyei and Ellen Animah Agyei are couples residing at Nyankyerenease New site near Asuyeboah.
She said the accused Sarfo Manu who claimed to be a hawker dealing in used cell phones at PZ, Adum on 9th of July 2016 about 2:30 am whilst the complainants were asleep two young men wearing masks, armed with a machete and a gun broke into their bedroom through the ceiling and woke them up and subjected complainant Samuel Kwaku Agyei to beatings, robbed him of Nokia lumia cell phone and again locked him up in the washroom.
DSP Amewu added they again robbed complainant Ellen Animah Agyei of her HP Pavilion 600 laptop computer, Itel cell phone, cash the sum of GHc 1,100.00 and bolted.
According to her a case was lodged to the police by the complainants and in the course of investigations, complainant Ellen Animah Agyei had an information from a relative family member whatsap group named “The Boadi’s”that her Airtel whatsap contact number 0263 76 15 36 has been changed to MTN number 0247 88 42 88.
She further told the court that the information gave the complainant lead that someone is operation her Itel phone which was robbed and continue that same information was given to the police and the police sought for an order from court to enable MTN service provider furnish police with an itemized bill on contact number 0247 88 42 88.
The Accused whatsap display pictures (DP) on his whatsap account was retrieved and same was being use to track him down DSP Doris told the court.
She said on 5th of December 2016 around 7:30am GC/2 Emmanuel Gifa of police SWAT/Ashanti spotted the accused at Bantama and effect his arrest and then brought him to the police station then complainant Ellen Animah Agyei came to the police station and identified him as the one she detected his display picture with MTN contact number 0247 88 42 88 that changed her contact 0263 76 15 36 on their family whatsap group.
She said the accused in his caution statement told the police that in the month of July, 2016 one Awudu now at large who is driver’s mate at Asafo- Kumasi sold Nokia and Itel phones respectively to him at the cost of GHc 200.00
That he used the Itel cell phone for some time with his MTN contact number 0247 88 47 88 and later sold it out.
However the accused also confirmed the display picture (DP) intercepted by the police as his and after investigation he was charged with the offence and now before the court saying the MTN Kumasi branch was contacted and they promised to furnish police with the itemized bill soon DSP Amewu added.
